Terms of Use
These Terms of Use ("Terms") govern your use of the Airline Transfer Partner Identifier ("Spreadsheet"), which is being provided to you by Max Miles Points LLC ("Provider"). By purchasing and/or using the Spreadsheet, you agree to these Terms. If you do not agree to these Terms, you may not use the Spreadsheet.
License Grant
Provider grants you a non-exclusive, non-transferable license to use the Spreadsheet for personal or business purposes, subject to the restrictions set forth in these Terms.
Restrictions on Use
You may not:
Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Spreadsheet.
Distribute, sell, sublicense, lease, lend, rent, or otherwise transfer the Spreadsheet to any third party.
Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices contained in the Spreadsheet.
Intellectual Property Rights
The Spreadsheet, including all intellectual property rights therein, is and shall remain the property of Max Miles Points LLC. You acknowledge that you have no ownership rights to the Spreadsheet except for the limited license granted herein.
Payment Terms
You agree to pay the price specified by Max Miles Points LLC for the Spreadsheet. Payment shall be made upfront as a one-time payment.
Refund Policy
No refunds will be issued for the purchase of the Spreadsheet.
Warranty Disclaimer
THE SPREADSHEET IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. MAX MILES POINTS LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
Limitation of Liability
IN NO EVENT SHALL MAX MILES POINTS LLC BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) ARISING IN ANY WAY OUT OF THE USE, REPRODUCTION, DISTRIBUTION, OR PERFORMANCE OF THE SPREADSHEET.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be exclusively resolved by the state and federal courts in San Diego County, California.
Additional Terms
The Spreadsheet is provided for personal or business use only and may not be resold or redistributed without the prior written consent of Max Miles Points LLC.
